Can I appeal the BSA's decision?

The BSA does its best to ensure that its decisions are fair and reasonable.  However you may not agree with the BSA's determination.

If you disagree with any aspect of the decision you have the right of appeal to the High Court.  You must bring this appeal within one month of receiving the BSA's decision.

You can appeal both the decision and the process the BSA used to come to that decision (known as a 'judicial review').

If you choose to bring an appeal you will be the Appellant and the broadcaster will be the Respondent.  The BSA does not take a formal role in the appeal but may appear to assist the Court.

If you are thinking of bringing an appeal you should seek some independent legal advice.  A lawyer will be able to help you lodge the necessary documents and advise you of the requirements for an appeal.

You should note that if your appeal goes to court and you lose the judge may decide to award some costs against you.
