Following its interlocutory decision finding it has jurisdiction under the Broadcasting Act 1989 to consider a complaint about The Platform’s Live Talkback,1 the Broadcasting Standards Authority has determined two complaints about online broadcasts by The Platform on 22 July 2025 and 15 October 2025 – both of which have been upheld.
22 July 2025 broadcast: Upheld – s 4(1)(a) good taste and decency
15 October 2025 broadcast: Upheld – s 4(1)(b) law and order; s 4(1)(c) privacy
No Order
The Authority has not upheld a complaint under the discrimination and denigration standard about a Mike Hosking Breakfast segment discussing the ‘demise’ of footwear company Allbirds. Hosking, referring to the problem of ‘dupes’, said ‘the Chinese will steal it from you, and they will make it for less’. The Authority accepted some listeners would find the comments offensive but, in context, found they were likely to be seen as referring to the business practices of some companies rather than Chinese people. The comments did not carry the invective or malice at a level that amounts to encouraging the denigration of, or discrimination against, Chinese people.

The Authority has declined to determine a complaint alleging a broadcast of the song ‘The Next Episode’ by Dr Dre (featuring Snoop Dogg and Nate Dogg) contained swearing – specifically, the ‘f word’. Since the edited version of the song broadcast did not contain the alleged language, the Authority considered, in all the circumstances, the complaint should not be determined.

The Authority has not upheld a complaint that a 1News item about an Auckland ‘March Against Antisemitism’ rally, held in the wake of the Bondi Beach Hanukkah Festival shooting, was unbalanced and inaccurate. The complaint was that the broadcaster failed to appropriately challenge rally participants on multiple points, resulting in omission of context and perspectives and the audience being misled, including by mischaracterisation of the rally and the suggestion Hamas was connected to the Bondi Beach shooting. The Authority found the balance standard did not apply because the broadcast, which focused on the concerns of the New Zealand Jewish community and commemoration of the Bondi Beach victims, was a report on events rather than a discussion of a controversial issue of public importance. In the context, it noted viewers would not have expected the broadcaster to challenge the rally participants or present the other perspectives outlined in the complaint. The Authority also found the inaccuracies raised either would not have materially misled viewers or concerned matters of opinion to which the accuracy standard does not apply.
Not Upheld: Balance, Accuracy
The Authority has declined to determine a complaint that an interview on Afternoons, shortly after an announcement the Broadcasting Standards Authority was to be abolished, breached the balance and fairness standards. The complainant said the interview lacked balance and fairness as it did not include the views or a representative of the BSA. Noting the nature of the broadcast and conflict presented by determining issues associated with itself, the Authority considered that, in all circumstances of the complaint, it should not be determined.

The Authority has not upheld a complaint that an interview on Saturday Morning with Baroness Dr Hilary Cass breached broadcasting standards. Dr Cass is the author of an independent review of NHS gender identity services for children and young people in England, whose findings contributed to the New Zealand Government’s decision to ban new prescriptions for puberty blockers to treat gender dysphoria or incongruence. The Authority acknowledged the complainant’s concerns about the harm that could result from the ban on puberty blockers in New Zealand, and that many New Zealand medical member associations have expressed strong concern about it. However, it found the interview was clearly signalled as presenting Dr Cass’s opinion on a controversial and unsettled debate (the long-term safety of puberty blockers in transgender healthcare) and did not breach the balance or accuracy standards. Further, discussion of Dr Cass’s professional opinions as a result of her review was not discriminatory against trans youth. The fairness standard did not apply.

The Authority has not upheld a complaint about a Mike’s Minute segment on Phase Two of the Royal Commission report Whītiki Aotearoa: further lessons from COVID-19 to prepare Aotearoa New Zealand for a future pandemic. The complainant alleged the segment presented ‘misrepresentations’ and inaccuracies about the findings of the report and was unbalanced and unfair. The Authority found the segment overall was consistent with well-established audience expectations of Mike’s Minute and the comments expressed were either clearly opinion or not materially misleading. The Authority also found the broadcast was not required to present significant perspectives under the balance standard, and the fairness standard did not apply.

The Authority has not upheld a complaint that a news bulletin on The Breeze about United States President Donald Trump’s social media post saying he was ‘glad’ Robert Mueller died, breached the accuracy and fairness standards. The complainant alleged the omission of Trump’s full post created a misleading and unfair impression of what he said. The Authority found the newsreader’s summary of Trump’s response was accurate, the post was correctly attributed, and the choice to include or not include the full post was at the editorial discretion of the broadcaster. Other national and international media outlets also reported on the post, which reduced the likelihood of the segment materially misleading the audience.
Not Upheld: Accuracy and Fairness
The Authority has not upheld a complaint that allowing an interviewee to wear what appeared to be a keffiyeh during an interview about the government’s introduction of new ‘move-on’ orders breached the offensive and disturbing content, discrimination and denigration, balance, and fairness standards. The Authority found broadcasting the interviewee wearing this garment would not have caused widespread disproportionate offence or distress, or have had the effect of encouraging discrimination against, or denigration of, Jewish people. It noted, if the garment was in fact a keffiyeh, the keffiyeh is not an anti-Semitic symbol, nor is showing support for Palestinians anti-Semitic. The balance and fairness standards did not apply.

The Authority has not upheld a complaint that a 1News segment was unbalanced in its reporting of ‘anti-government protests’ in Iran. The complaint was that the broadcast should have mentioned what the complainant considered to be external drivers, including the interests and past actions of other nations. The Authority found the broadcast was clearly focused on the current protest situation (including that it was hard to determine exactly what was happening because of the internet blackout in Iran); and the perspective of those gathered in Auckland in solidarity with the Iranian community, on the evening of the broadcast. The omission of the factors identified in the original complaint did not render the broadcast unbalanced or misleading. No allegation was made in the original complaint of unfairness to a particular individual or organisation taking part or referred to in the broadcast.
