Summary [This summary does not form part of the decision. ]An item on 3 News which reported on a shooting massacre in a Kenyan Mall included footage of a man trying to hide, and then being shot at point blank range. The newsreader warned that the story contained ‘disturbing images’. The Authority upheld the complaint that this warning was inadequate to prepare viewers for witnessing a horrific execution. While recognising the very high public interest in the story and in the footage, viewers were not given a reasonable opportunity to exercise discretion or make a different viewing choice. The Authority did not make any order, as the decision provides sufficient guidance to broadcasters....

SummaryThe "Bluffer’s Guide" is a regular feature of Ansett Time of Your Life. In the programme broadcast on TV3 on 26 May 1998 at 8. 00pm, it focused on cigar smoking. Mr Pester of Pahiatua complained through the Broadcasting Standards Authority to TV3 Network Services Ltd that the programme glorified cigar smoking in a manner which would be attractive to young people. He argued that TV3 had employed a deceptive programme practice because it encouraged young people to smoke cigars, and that it had failed to be mindful of the effect of the programme on children. In addition, he contended that it had contravened the Smokefree Environments Act 1990. TV3 responded that the programme, while rated G, was aimed at a mature audience. The Authority upheld the complaint that explicit sexual references contained in the promo went beyond the boundaries of the G classification and consequently the broadcaster did not adequately consider the interests of younger viewers who were likely to be watching. Summary The film Heat was broadcast on TV2 at 8. 30pm on 3 January 1999. Mr Nicholls complained to Television New Zealand Limited, the broadcaster, about the standard of language used in the film. He objected to the excessive use of "fuck", "fucking", and associated words, he wrote, because it led to their normalisation. He argued that the offending words could have been beeped out. The film was shown in holiday time, he said, and swear words should not be accepted on prime family time television. TVNZ responded that the film started at 8. 30pm which was adult programming time, it was clearly rated AO, indicating that it was unsuitable for children, and it was preceded by a specific warning about its violence and language. It said the warning was delivered visually and verbally....
