[2] Gus Hastie made a formal complaint to TVWorks Ltd, the broadcaster, alleging that the movie contained nudity and sex scenes close to the 8. 30pm watershed, in breach of standards relating to children’s interests. Summary[This summary does not form part of the decision. ]An item on Newshub by political editor Patrick Gower reported on National Party Leader Bill English’s claim that the Labour Party would raise income tax if they won the 2017 General Election. Mr Gower stated that the National Party was ‘deliberately spreading misinformation’ about Labour’s income tax policy. The Authority did not uphold a complaint that Mr Gower deliberately misled the public prior to the election. The Authority emphasised the importance of freedom of political expression, particularly in an election year. The Authority considered significant viewpoints on the issue discussed were adequately presented in the broadcast and within the period of current interest, enabling the audience to form their own opinions. The Authority also found that the comments complained about were statements of analysis and opinion, rather than statements of fact, so the accuracy standard did not apply....

The Authority has not upheld a complaint images included in a 1 News item regarding the Children’s Commissioner’s report on child poverty breached the discrimination and denigration standard. The Authority did not consider ‘people in poverty’ to be a recognised section of the community for the purposes of the standard. The Authority has not upheld a complaint about a ‘Carpool Kōrero’ segment in an episode of Popstars during which a celebrity guest talked to each of the contestants while apparently driving a car. The complainant alleged a young person may have been unable to discern the guest was not in fact driving, and therefore the broadcast breached the law and order standard. The Authority found reasonably attentive viewers would have likely understood the segment took place in a simulated environment and in any case the broadcast was unlikely to encourage audiences to break the law. The Authority has not upheld a complaint about a promo which contained a joke that New Zealand’s duck hunting season had been off to a bad start because ‘someone accidentally shot Trevor Mallard’. Viewers would have understood the comment as a joke, and it was unlikely to cause widespread undue offence or encourage illegal activity, nor did it contain unduly disturbing violent content. A news item on the centenary celebrations of the Chinese Communist Party reported that as part of President Xi Jinping’s speech he said ‘anyone opposing China will have their heads bashed against a great wall of steel’. The complainant alleged this was inaccurate and unbalanced, mainly because TVNZ had cut off the full quote, which clarifies the ‘great wall of steel’ is forged by ‘1. 4 billion Chinese people’ and therefore conveys a more metaphorical meaning. The Authority found the item did not breach the accuracy standard on the basis that the broadcast was not likely to mislead viewers as a result of omitting part of President Xi’s sentence, and it was not inaccurate for TVNZ to use the more literal translation of ‘heads bashed’ over ‘collide’ in its translation....

The Authority has not upheld a complaint under the accuracy standard in relation to an interview on AM with Dr Russell Norman about agricultural emissions. The complainant alleged Dr Norman’s statements concerning dairy cow numbers, the herd getting larger, and the amount of effluent produced by cows were inaccurate. The Authority found two of the statements were materially accurate and would not have misled the audience, and the third was analysis, comment or opinion to which the accuracy standard does not apply. The Authority has declined to determine aspects, and not upheld the remainder of a complaint concerning a talkback call regarding vaccine mandates. The complainant had contacted the station and spoke about her son’s issues re-enrolling at university due to his COVID-19 vaccination status. The complainant alleged the broadcast breached the balance, accuracy and fairness standards as the host did not accept the complainant’s statements concerning the COVID-19 vaccine and related mandates, and prematurely ended the call with the complainant. The Authority declined to determine the complaint under the balance and accuracy standards as the complainant’s concerns have been recently determined in other decisions. The Authority did not uphold the fairness complaint, finding the complainant was not treated unfairly and in any case it was an editorial choice open to the broadcaster to end the call....
