Summary An advertisement for a light truck contained language which had been the subject of complaints to the Advertising Standards Complaints Board (ASCB). The Board’s decision on those complaints was reported in a news item on TV3’s 3 News on 23 March between 6. 00–7. 00pm. Extracts from the advertisement, including the offending language, was included in the item. Mr Shierlaw complained to TV3 Network Services Ltd that by screening the advertisement before 8. 30pm, as required by the ASCB, TV3 had failed to comply with standard G5 of the Television Code of Broadcasting Practice, which requires broadcasters to observe the principles of the law. Summary Four appliance repair centres were given a faulty microwave oven to repair and the results were reported on Target broadcast by TV3 Network Services Ltd on 6 June 1999 between 7. 00–7. 30pm. Manukau Appliance Service Centre Ltd repaired the microwave by bypassing the variable power switch with the result that it could only operate on high power. Mr Welch, Managing Director of Manukau Appliance Service Centre, complained to the broadcaster that the item was unfair to his company because it left the impression that his staff were incompetent in locating faults in electrical equipment. Of major concern, he said, was that TV3 had failed to include explanatory comment from the company about the work it had done. An application by TV3 Network Services Ltd for an interim injunction failed in the High Court: CP 81/99 PDF2. 73 MB INTERIM DECISIONA number of complaints were referred to the Broadcasting Standards Authority concerning a 20/20 item entitled "Sex, Lies and Videotape" broadcast on TV3 on 28 June 1998 and a related news item broadcast on 3 News on 29 June 1998. There has been extensive correspondence between the complainants, the broadcaster and the Authority in the intervening months. On 24 March 1999, the Authority received advice from the solicitors acting for TV3 in which they noted that four of the principal complainants had alluded to the possibility of taking defamation proceedings against TV3. TV3 argued that the Authority would be severely prejudiced if the complaints were allowed to proceed under these circumstances....
