Summary A prison officer, accused of a sexual relationship with an inmate, was the subject of a 20/20 item entitled "A Pregnant Silence" broadcast on TV3 on 13 September 1998 between 6. 30–7. 30pm. K complained to the Broadcasting Standards Authority under s. 8(1)(c) of the Broadcasting Act 1989 that the broadcast breached her privacy because it included footage of her house when the prison officer, who was her flatmate, was filmed leaving her home. She observed that its identity was clear because the house number was clearly shown. She argued that when personal details were given about the officer, it could have been incorrectly inferred that he lived at that address with his family. K sought an assurance that no more footage of her house would be shown as she had no connection with the story....

Summary A hidden camera was used on a Target programme broadcast on TV3 on 9 July 2000 to assess whether a car’s wheel alignment had been properly carried out. The footage broadcast included pictures of the outside of the business premises, and members of the staff dealing with the customer. Chris Clarke, the proprietor of Action Auto Services, complained to the Broadcasting Standards Authority about the broadcast, arguing that the filming had been carried out unlawfully on his premises. His complaint concerned the promos for the programme as well as the programme itself....

SummaryConcern about repeat drink/driving offences was dealt with in an item broadcast on both 3 News and Nightline, on TV3 between 6. 00–7. 00pm and 10. 30–11. 00pm respectively on 22 February 1999. The item included footage of the police dealing with drivers who had been drinking, and included a segment showing a woman struggling violently as she was put into a police car. Ms M, the struggling woman, complained to the Broadcasting Standards Authority that the item breached her privacy. The incident screened had occurred seven years previously, she wrote. She recalled that she had been struggling at the time as she considered that she had not been treated fairly by the police when they insisted that she undergo a breath test although she had not been driving. SummaryA segment on consumer rights relating to boundary fences was included in Target broadcast on TV3 on 29 August 1999 beginning at 7. 00pm. A brief shot of a man’s buttocks was seen in a skit performed by two actors. Dawn Shelford, on behalf of Preserving Communication Standards Trust Inc, complained that she and the members of her group found this segment objectionable. She said they did not consider it appropriate for this segment to have been included in a consumer rights programme as it was "a kind of titillation based on public indecency". TV3 responded that the 7-second view of the actor’s bare bottom was in its view acceptable in the context. It did not agree that the scene was objectionable and exceeded community standards of decency. It declined to uphold the complaint. Summary A rugby coach found guilty of sexually assaulting young boys in his rugby club was described on a 3 National News item broadcast on 31 July 1998 as a "homosexual paedophile" and, according to a sports reporter on a 3 News Update item broadcast on 2 August 1998, the Gay Games contained events such as handbag throwing and the 200m dash in high heels. Calum Bennachie complained to TV3 Network Services Ltd that the description of the rugby coach implied that all paedophiles were homosexual or that all homosexuals were paedophiles, and that both implications were factually incorrect and portrayed gay and lesbian people as inherently inferior. He also complained that the emphasis on fringe events in the report on the Gay Games trivialised the achievements of the competitors....

She was named in the report, and a photograph of her was included in the item. In addition there was film footage showing the reporter knocking at the door of her home. Kevin Niederberger complained to the Broadcasting Standards Authority under s. 8(1)(c) of the Broadcasting Act 1989 that the teacher’s right to privacy had been violated by naming her, showing her photograph and filming her at her workplace....
