Mr Gower stated that the National Party was ‘deliberately spreading misinformation’ about Labour’s income tax policy. The Authority did not uphold a complaint that Mr Gower deliberately misled the public prior to the election. The Authority emphasised the importance of freedom of political expression, particularly in an election year. The Authority considered significant viewpoints on the issue discussed were adequately presented in the broadcast and within the period of current interest, enabling the audience to form their own opinions. The Authority also found that the comments complained about were statements of analysis and opinion, rather than statements of fact, so the accuracy standard did not apply....

Summary[This summary does not form part of the decision. ]The Authority has not upheld a complaint that the use of the term ‘disputed’ in a Newshub item, to describe the land the United States (US) Embassy sits on in East Jerusalem, breached the accuracy standard. The broadcast covered a recent protest in Gaza over the opening of the US Embassy in Jerusalem and the US calling Jerusalem the capital of Israel. The Authority noted that the accuracy standard requires only that the broadcaster make ‘reasonable efforts’ to ensure the accuracy of the broadcast. In this case, the reporter used the term ‘disputed’ in the ordinary sense of the word, to identify the US Embassy’s location, which is the subject of dispute between Palestine and Israel....

The item included photos of the camp attendees, sourced from public social media accounts, with no masking or blurring. The Authority upheld a direct privacy complaint from IY, who was featured in the photos, that this item breached their privacy. The Authority noted the value of the broadcast in reporting on the response of the Labour Party to the allegations, but emphasised the high level of potential harm that could be caused to the individuals involved....

The Authority did not uphold complaints that the Newshub items and the reporters’ comments were biased, unfair and derogatory towards the United Kingdom and/or members of the British Royal Family. The Authority found that the news reports did not contain any material which discriminated against or denigrated any section of the community, or which could be said to be unfair to members of the British Royal Family. The Authority has not upheld a complaint that a Newshub Nation item reporting poll results on support for Auckland Central constituency candidates was misleading, as it excluded undecided voters. There was lengthy discussion that followed concerning the poll results and the views of each of the candidates, and at the end of the item, the reporter advised more than 20% of voters still had not decided which candidate to support. The Authority has declined to determine a complaint about the introduction to a news item on New Zealand Rugby which used the terms ‘blasted’ and ‘bombshell’ immediately after an item reporting on violence in Gaza. The Authority considered that the complaint raised issues which were editorial decisions not properly addressed by broadcasting standards, so should not be determined by the Authority. The Authority has not upheld a complaint that a series of interviews broadcast on Newshub Nation were unbalanced. The complainant alleged that an Israel Defence Force (IDF) spokesperson was given free rein to repeat propaganda, and while other perspectives were included, none of these were the perspectives of Hamas or a Palestinian spokesperson. The Authority found while the issue of the Israel-Hamas conflict is a controversial issue of public importance, the broadcast included sufficient perspectives on the matter for the purposes of the standard. The Authority has not upheld a complaint about an interview on Newshub Nation, featuring electrical engineer and Pike River Mine researcher, Richard Healey. Mr Healey commented on his claims of ‘new crucial evidence’ the miners could have survived the explosions and of the existence of a pipeline which could be used to recover more evidence. The complaint alleged Mr Healey’s claims were speculative and unsupported by evidence, were not challenged by the host and caused emotional harm to the victims’ families. The Authority acknowledged the sensitivity of the matters discussed, which also carried a high degree of public interest. It found the broadcast clearly presented Mr Healey’s claims as one theory and from a particular perspective. The wide range of information and coverage available over a long period of time since the original events reduced any risk of viewers being misled or significantly misinformed....
