The Authority did not uphold the complaint that the item was unbalanced because it did not present the anti-1080 viewpoint. The item’s focus was not the use of 1080 so it was not necessary to put forward views for and against its use, but in any case the broadcaster alluded to three earlier items on this specific beech mast event which did refer to alternative views....

Summary[This summary does not form part of the decision. ]An episode of Criminal Minds featured the murder of three restaurant workers during an armed robbery, prompting the FBI’s Behavioural Analysis Unit to re-open a similar cold case that occurred six years earlier. The episode contained violence and drug use. The Authority did not uphold the complaint that the episode breached broadcasting standards relating to responsible programming, children’s interests and law and order. The Authority found that while the episode contained challenging content, it was classified AO and was preceded by an adequate warning. The programme’s classification, pre-broadcast warning and established reputation as a crime drama enabled viewers to make an informed viewing decision. The programme did not contain visual acts of violence, and the drug use was not portrayed in an instructional or encouraging manner and was part of the episode’s narrative context....

Following the 15 March 2019 attacks on two mosques in Christchurch, 1 News at 6pm twice broadcast an edited clip taken from the alleged attacker’s 17‑minute livestream video. The Authority did not uphold a complaint that the broadcast was in breach of the good taste and decency and violence standards. The content of the clip, and the broadcast as a whole, was newsworthy and had a high level of public interest. The very brief clip was an edited segment of the livestream video which provided information to audiences, but which did not contain explicit graphic or violent content and did not promote or glorify the actions of the attacker. Specific warnings and extensive signposting ensured audiences were sufficiently informed about the disturbing nature of the content....

The Authority has not upheld a complaint a news report on 1News breached several standards, by using the phrase Hamas ‘fighters’, rather than Hamas ‘terrorists’. The Authority found the choice of word could not reasonably be said to encourage the different treatment of Jewish or Israeli people, devalue their reputation, or embed negative stereotypes about them. Under accuracy, the Authority found the word was not inaccurate, was not material in the context of the broadcast as a whole, and there was no harm at a level justifying limitation of the broadcaster’s right to freedom of expression and editorial independence. A promo for James Must-a-pic His Mum a Man aired during the programmes The Chase at 5. 10pm and 1News at 6. 50pm on TVNZ 1. The 14-second promo featured James Mustapic and Art Green sitting at opposite ends of a bathtub, with Mustapic asking Green for dating advice on behalf of his mum. The Authority did not uphold a complaint the promo breached the children’s interests standard due to nudity, noting only their chests and legs were visible, and there was no suggestion of sexual behaviour. The Authority has not upheld a complaint that a 1News item on the government’s proposed amendments to expand citizen’s arrest powers, as part of its efforts to address retail crime, breached the balance standard. The complaint alleged the report ‘crossed the line’ into political bias by focusing on violent robberies and interviewees expressing concerns about increased danger and vigilantism, while failing to mention the proposed changes were intended to address incidents such as supermarket shoplifting. The Authority found the balance standard had not been breached as the item included significant perspectives on the government’s proposal, including comments from Justice Minister Paul Goldsmith’s announcement. Summary An item on the Holmes programme examined the situation of a woman and her eight year old son who was described as suffering from Attention Deficit Disorder Syndrome. Footage of the child, exhibiting what were said to be some behavioural problems of the syndrome, was shown on the programme which was broadcast on TV One on 4 March 1999 commencing at 7. 00 pm. Ms Burnell complained to the Broadcasting Standards Authority under s. 8(1)(c) of the Broadcasting Act 1989 that the programme violated the child’s rights of privacy and confidentiality. He was identified by his first name, his face was visible, and he clearly expressed his total opposition to being filmed for public viewing, she wrote....

Summary The dissatisfactions expressed by a number of students at the New Zealand Film and Television School in Christchurch were examined in items broadcast on Holmes on 15 and 16 December 1998. A follow-up item was broadcast on Holmes on TV One between 7. 00–7. 30pm on 12 April 1999. The Managing Director of the New Zealand Film and Television School Ltd (Ms Marilyn Hudson) complained to Television New Zealand Ltd that the April item was unfair and unbalanced, and inaccurate in a number of respects. In the episode, the host showed a couple around three houses in Greytown, each of which had ‘for sale’ signs on their fences indicating they were for sale through a particular real estate agency. The complainant considered it was misleading that the broadcaster did not disclose two of the houses were actually ‘off-market’ sales, and citing values for these houses would have given viewers an inflated impression of the market value of the houses, and the Greytown property market generally....

The Authority has not upheld a complaint about an episode of Queer Aotearoa in which it was stated the Human Rights Act 1993 (HRA) outlaws discrimination based on sexual orientation or gender identity. The complaint was made under three standards: discrimination and denigration, accuracy and fairness. The Authority found the statement was a genuine expression of serious comment, analysis or opinion rather than something likely to incite discrimination or denigration.
